New Rules & Penalties
The next phase of the EU AI Act takes effect. New obligations and drastic sanctions will soon apply to AI models like ChatGPT. An overview of the changes.

1. New Rules for General-Purpose AI Models
On August 2, 2025, the next important phase of the European AI Act comes into force. From this date, general-purpose AI models (GPAI) like ChatGPT, Gemini, or Claude will be directly covered by the regulation.
Special Focus: Models with Systemic Risk
Particularly powerful AI models that required more than 10²⁵ floating-point operations (FLOPs) for training are considered models with systemic risk. Stricter obligations apply to them.
2. Drastic Sanctions for Violations
Alongside the new rules, the AI Regulation's sanction provisions also come into force. The penalties follow the GDPR model.
Up to €35 million or 7% of global annual turnover
...for violations of prohibited AI practices (e.g., social scoring).
Up to €15 million or 3% of global annual turnover
...for disregarding transparency obligations or deploying high-risk systems without conformity assessment.
Up to €7.5 million or 1.5% of global annual turnover
...for providing false or misleading information to authorities.
The higher amount is used for calculating the penalty.
3. Guidelines and Code as 'Model Solution'
Since the AI Regulation is open to interpretation in many places, the EU Commission has published guidelines and a code of conduct.
Core Areas of the AI Code of Conduct
- Transparency about training data, model size, and measures to mitigate bias.
- Protection of copyrights, e.g., by respecting opt-outs during data collection.
- Security and hazard prevention, including against discrimination, data leaks, and creation of illegal content.
4. The Official Timeline at a Glance
Implementation of the AI Regulation is phased. Companies should keep the following deadlines in mind:
August 2, 2025
Obligations for GPAI providers come into force. This marks the beginning of a transition phase.
August 2, 2026
The EU AI Office's enforcement powers become effective. From this date, fines can be imposed for violations.
August 2, 2027
Grace period ends: AI models already on the market before August 2025 must now also fulfill all obligations.
